Protection of women’s property rights

Mrs. Sujata Vijay Borkar filed a petition for grant of a permanent injunction restraining her husband, his relatives or his agents from selling, transferring or creating any third party interest in the petitioner’s matrimonial home and also for not disturbing her peaceful possession.

 

Case Details and Status

In passing judgement, Judge Lohiya noted that, as the proceedings were for grant of an injunction, he would only need to decide whether the house where Mrs. Sujata Vijay Borkar was living was her matrimonial home.

Ultimately, it was not disputed that the marriage between Mrs. Sujata Vijay Borkar and Mr. Vijay Manohar Borkar took place and that they cohabited at the residence in question after their nuptials. 

As a result, the judgement restrained the respondent from selling, transferring or alienating the matrimonial home or from removing Mrs. Sujata Vijay Borkar from the premises through himself, his relatives and agents, by grant of a permanent injunction.
