Delhi District Court cancelled acid attack accused bail for repeatedly threatening the complainant

Complainant is 27 years old and is employed as a laborer in a factory in Bawana Industrial Area. She was married to the accused in 2015.She has been facing constant harassment and cruelty in the hands of her husband and in-laws. She was constantly subjected to physical as well as emotional abuse by the accused .In early August 2018, due to the strained nature of the relationship between the accused and the complainant, family and friends constituted a mediation process where it was decided that both the complainant and the accused should separate and apply for mutual divorce. Pursuant to this, the complainant left her in-laws’ house and moved back into her maternal house and started working as a labourer.

On 20.08.2018 around 6:00 pm, when the complainant and her aunt were leaving for home from her workplace, the accused physically assaulting her. During this agitation, the accused opened the bottle of acid that he was carrying and threw acid on the complainant. The acid caused seriously injuries to the complainant on her face and her arms. An FIR bearing no FIR 352/2018 was lodged under section 326A of the Indian Penal Code, 1860 with PS Bawana pursuant to the abovementioned incident. The concerned authorities conducted investigation and arrested the accused. However, the accused moved an application before the Hon Metropolitan Magistrate, Rohini Courts on 29.03.2019 and the Hon Magistrate granted bail to the accused on the same day.

However, since getting bail, the accused had been making repeated phone calls to the complainant and her family and had  been threatening the accused. On 04.05.2019, at around 11:00 pm the accused telephoned the complainant’s brother and asked him to give the phone to her and  further threatened her saying that last lime he just threw acid and this time he would go further to even murder her. He further stated that he knows exactly where she works and where she takes the rickshaw and hence will come looking for her. When the complainant's advocate brought this thing before the Hon Court and Hon Court found it true and cancelled the bail of the accused and directed him to sent to the jail.
