Category: Public Servants In case act is instrinsically connected with official duty, sanction under S. 197 CrPC, necessary. But such relation to duty must not be fanciful or pretended claim. There cannot be any universal rule to determine whether there is reasonable nexus between act done and official duty. Public Servants is not entitled to indulge in criminal activities and in such sanction under S. 197, not required. Held, trial court to re-examine the requirement of sanction based on the reasonable nexus test.
