Lawyers of victims of Mirchpur dalit case under threat, SC orders inquiry

The advocates fighting for victims of Mirchpur dalit atrocities case are being harassed and threatened by the dominant upper caste groups in order to deter them from fighting the ongoing legal battle against ghastly caste violence which occurred in Mirchpur, Haryana in April 2010. Senior Advocate Colin Gonslaves approached Supreme Court praying for Chief Minister and Police to give an undertaking to Supreme Court guaranteeing effective protection to lawyers by Central Reserve Police Force, for their temporary accommodation in Delhi, and for an order of recovery of their case files and lodging of FIR. Supreme Court, after hearing the parties, has ordered an inquiry by Chief Judicial Magistrate and Senior Superintendent of Police into the incidents mentioned by the petitioners and to file a report to Supreme Court within two weeks. Advocate Shri Rajat Kalsan, his advocate father Shri Rikhi Ram, other lawyers including Shri Rohit Kalsan, Shri Surender Yadav, Shri Bhagat Singh Ranga and Shri Vishal Vimal, and their families are facing harassment, attack, death threats, false criminal cases at the hands of accused persons in Mirchpur case who belong to the dominant upper caste, while local police and administration remain mute spectators. On 04.04.11, Advocate Rajat Kalsan's office was ransacked and all his case files were taken away by a crowd of 50-60 people in the presence of senior police officers. No action was taken by Haryana Police in this regard. When the lawyers protested against this, on 16.04.11, a more serious assault took place inside the bar room in Hansi area where the President of the Bar Association, Surajmal Jakhar attacked Advocate Shri Rikhi Ram. Advocate Shri Rikhi Ram, a senior member of the Bar and father of Advocate Shri Rajat Kalsan, is a well-known name in Hansi for fighting for the rights of dalits. During the assault he received head injuries and was admitted to the hospital. However he was relieved on the day the matter was heard in the Supreme Court, without being handed over copies of his medical reports. Shri Rajat Kalsan who came later to save his father has been implicated under S.307, attempt to murder, alongwith his father and brother. The two lawyers who were present there and tried to intervene have also been falsely implicated. Even the security guard provided to protect the lawyer Rajat Kalsan was not spared and a criminal case has been slapped against him as well. This state of utter lawlessness has been brought to the notice of Hon'ble Supreme Court which is expected to pass orders after inquiry report is filed. In the meanwhile, the lawyers are still being threatened and fear for their lives.
