Manipur HC directs payment of compensation in various fake encounters by armed forces

Guangbi Dangmei Vs The Union of India & 4 others (WP(C) 943/2014) The petitioner’s son was killed in a fake encounter by the 10th Assam Rifles. After initiating a judicial inquiry which established the fake encounter, the court observed that the case happened to be that of unconstitutional deprivation of fundamental right to live and liberty, and said that thereby petitioner would be entitled to compensation and court has directed the Respondent No. 1 & 3 to pay a sum of Rs. 5 lakhs as compensation to the Petitioner, the father of the deceased within a period of three months from the date of receipt of the copy of the order. (Please see Order 1 below) Kh. Nagor Singh Vs The Union of India & ors (WP (Crl) 31/2008) The Petitioner’s son, Khumanthem Ajitkumar, was killed in a fake encounter by personnel of the 19 Rajput Rifles (Bikaner) who picked him up from his house in the intervening night of 14 and 15 March 2004, at about 1 am. According to the High Court order, a judicial inquiry was initiated by the district judge, based on the findings of which, the court directed the payment of Rs 5 lakhs as compensation to the Petitioner. (Please see Order 2 below) LR Kom Versus The State of Manipur & ors (WP (Crl) 54/2009) The Petitioner’s husband, Khumukchan Thoiba, was killed in a fake encounter by personnel of the Manipur Police Commando and 21 Assam Rifles after being picked up from his house on January 19, 2009. The Petitioner filed a case before the High court and as per order of the High Court, a judicial inquiry was initiated by the District judge, based on the report of which, the court directed the payment of Rs 5 lakhs as compensation to the Petitioner. (Please see Order 3 below) Ngangbam Kamalini Devi Versus The State of Manipur and 3 ors (WP (Crl) 27/2010) The court directed the respondents to pay a sum of Rs 5 lakhs to the Petitioner as compensation for killing her son, Ngangbam Naoba@ Phulchand Singh in a fake encounter. The encounter was by personnel of the Manipur Police Commando. The court asked the payment to be made to the petitioner within a period of four months, failing which it would carry an interest at 9% per annum. (Please see Order 4 below) H (O) Maipakpi Leima -Versus- The Union of India and ors (WP (Crl) 38/2013) The court directed the Respondents to pay a sum of Rs 7 lakhs as compensation to the Petitioner for killing her son, Hawaibam Amujao Meitei in a fake encounter by the personnel of the Assam Rifles on March 18, 2010. (Please see Order 5 below) Thangjam Ongbi Apabi Devi -Versus- The Union of India and 4 ors (WP(C) 155/2015) The court directed the Respondents to pay a sum of Rs 7 lakhs as compensation to the Petitioner for killing her son, Thangjam Thoithoi alias Anilkumar in a fake encounter, which was done by personnel of the Manipur Police Commando and 18th Sikh Regiment on January 14, 2012.
