Smti Papu Miso Vs state of Arunachal Pradesh [WP(C) no.425 (AP) of 2015] In the Gauhati High Court, Permanent branch Itanagar. SYNOPSIS Smti Papu Miso has filed a petition on access to basic health facility. The petitioner is a pregnant woman resident of Hunli, lower Dibang valley district of Arunachal Pradesh who is incapable of accessing the schemes bestowed to them by the central government and state government. The respondent’s authority has failed to assist them proper medical facilities. The present petitioner seeking directions to make the community health centre (CHC) as per the minimum standard of Indian public health standards (IPHS), for ensuring proper implementation of national health mission (NHM). The Hunli CHC is located in a remote area of lower Dibang valley District. It is a landslide prone zone area and there is bad road communication. Generally, pregnant women have to come to district hospitals covering 90 km for antenatal checkups. In this condition it becomes very difficult for the pregnant women to travel far of places frequently for checkups and deliveries. Most of the women travel to Assam for further treatment if any complication comes. The unavailability of medicine in the CHC compels the people to depend on GREF medical for treatment. People are deprived of all their health rights and also unfamiliar with the government schemes. The infrastructure of Hunli CHC is in very poor condition, windows and walls are all broken, no electricity 24/7, no proper toilet facilities, no labour room, no inpatients facilities and very importantly Ambulance service. Under section 4 of the IPHS guidelines the general hospital should have a building of its own, the road, electricity, water supply and communication facilities which should be available in all the CHC hospitals. The respondent authority failed to provide basic facilities which come under the government health issues programs which Indian constitution have provided, especially for the maternal health care service. There are many maternity death take place due to silly reasons and failure of basic requirements. STATUS The petitioner Smti Papu Miso under WP(c) 425(AP) 2015 Writ petition has prayed for ensuring health rights of pregnant women/ lactating mother, citing non-implementation of Indian Public Health Standard (IPHS) guidelines in Lower Dibang Valley District of Arunachal Pradesh. The infrastructure facilities of District Hospital, Primary Health Centers etc as depicted in the writ petitions and the photographs attached in the petition seems to be miserable. Learned counsels appearing on behalf of the state respondents have prayed for further time to obtain necessary instructions. In the interim, the respondent authorities are directed to implement the minimum requirements as per the guidelines of Indian public health standard (IPHS) in the hospitals and health centers without any delay.
