PIL filed for enforcement of the right to have pothole-free road in reasonable condition in Tripura's Khamper village

Smt. Manimala Debbarma vs BDO, Hezamara R.D. Block, & Ors SYNOPSIS The Public Interest Litigation (PIL) has been filed for the enforcement of the right to have pothole-free road in reasonable condition. Two brick soling road projects were implemented from Kalidhan para to Bargachia para under Paschim Chandpur ADC village committee during two financial years of 2013-2014 and 2014-2015. But the said brick soling road remained incomplete over the village Khamper para till today. The two projects are as follows, namely, Construct of Lying Brick soling road starting from Kalidhan para to Bargachia para of Purba Tamakari ADC Village (250 Population Road) under Hezamara R.D. Block under MGNREGA during 2013-2014, under Paschim Chandpur ADC Village Committee. The estimate cost was Rs. 30,36,013/-. Name of Implementing Officer with Designation: Sri Goutam Debbarma, J.E. (Junior Engineer). Name of Supervising Officer: Sri Indrajit Bhowmik, AE, RDD-1. Name of Programme Officer: Sri Jogesh Reang, (BDO), Hezamara R.D. Block. Construct of Lying Brick soling road starting from Kalidhan para to Bargachia para of Purba Tamakari ADC Village (250 Population Road) under Hezamara R.D. Block under MGNREGA during 2014-2015; under Paschim Chandpur ADC Village Committee. The estimate cost was Rs. 14,17,086/-. Name of Implementing Officer with Designation: Sri Goutam Debbarma, J.E. (Junior Engineer). Name of Supervising Officer: Sri Saibal Bhattacharjee, AE, RDD-1. Name of Programme Officer: Sri Jogesh Reang, (BDO), Hezamara R.D. Block On 06.06.2016 the Petitioner made a representation to the District Magistrate and collector, West Tripura, requesting to complete the said brick soling road. She also filed a representation before the Principal Secretary to Department of Rural Development, Govt. of Tripura requesting to complete the said road. But no initiative has been taken to complete the said road and the local people have been suffering a lot by using incomplete and damaged road. The Petitioner resides at village Khamper para beside the said road side. She has been suffering the most over the last two years by using the said road and aggrieved for inconvenience caused by the Respondents. The road is severely fragmented, narrow and full of potholes on the road. No car or motor vehicle can run over the said road. The Respondents did not place bricks over the road of village Khamper para and made the road narrow and unsafe. The Respondents are responsible and accountable for construction, upkeep and maintenance of the said soling road out of the sanctioned funds. Hence, this petition has been filed to make the Respondents liable and make the incomplete road complete for public convenience.
