SYNOPSIS The petition was filed for issuance of writ of mandamus directing the respondents to grant a sum of Rs. 10,000/-( Rupees Ten thousand) under the National food security Act, 2013 to the petitioner and sum of Rs.700/- under cash assistant during pregnancy under JSY scheme and reimbursement out of pocket expenses under the JSSK. The petitioner is lactating mother and delivered a baby girl on dated 19/01/2016. The petitioner has submitted a claim application/representation under sec.4 (b) of National Food Security Act before concerned authority for grant of Rs.10,000/-( Rupees Ten thousand only) for maternal benefit of lactating mother, however there is no response from the concern authority and the application/ representation submitted by petitioner is laying authority. Hence this writ petition. The petitioner herein is the citizen of the Indian and Permanent resident of Old Hassang Village, Changlang District of Arunachal Pradesh and is the local tribe of the state. She is the mother of two children and had delivered her first child at Namtok Primary health centre (PHC). During her 2nd pregnancy as Namtok PHC was not well equipped she was referred to Asom, Margarita civil Hospital due to Critical pregnancy, where she had to spend Rs 8000 out of pocket expenses for her treatment. Beneficiaries was not even supported by any nutritional food during her maternal days as per the National Food Security Act, 2013 which mandates free of charge meal during the pregnancy and six month after child birth, through the local Angandwadi, to meet the nutritional standards specified.
