This PIL was filed to issue order or direction by the court to conduct household survey of children upto 14 years in accordance with the Bihar State Free and Compulsory Education for Children Rules, 2011 and to conduct school mapping in accordance with the RTE Act and Rules formulated thereon. This was also to reserve 25% of seats in un-aided private and recognized schools for the economically weaker sections of the society, to complete the process of registration of the schools and to ensure that only trained and qualified teachers are incorporated in them. The said age group also included an adolescent girl belonging from a weaker & marginalized section for whom education is the only tool for transforming their faith and improving their mental & sexual health because proper education can only make them aware of their rights and liabilities with respect to health and social security. Further, their education will also make sure in their life span that all children in her family are educated. Judgment & Impact The Director, Primary Education of the Government of Bihar was directed to be personally present in the court and was asked to explain the implementation of the Right to Education Rules and to enumerate on the policy of the Government on Household survey, School Mapping and implementation of the rules. Consequently, the State Government conducted a thorough survey & investigation of the Govt. Schools in Bihar wherein several discrepancies & shortcomings were found. The Case is Pending and has been reported several times in the newspapers.
