The facts of the case are that Respondent approached NGT in OA No. 22 of 2012 against MoEF, State Pollution Control Board and Department of Mines and Geology for order or direction to respondent to close down mines in State of Goa which do not have valid EC following High Court Judgment in Shankar Raghunath Jog with immediate effect which has led to environmental degradation. It was held that OA No. 22 of 2012 pending on file of NGT will not survive in as much as Respondent mainly placed his prayer based on impugned order. Transfer petition allowed directing OA No. 22 of 2012 to be transferred to Supreme Court and OA stands dismissed as becoming infructuous.
