Shri B.R Chakma & ors Vs State of A.P and 4 ors [WP(c) 219 (AP) 2017]In Gauhati High Court, Itanagar Permanent Bench] The Petitioners were the unfortunate victims of flood that occurred due to the rise of water level of Nai-Dihing River in April to July 2016. They filed writ for immediate relief to their families. During the monsoon of 2016, the villages of Dumpani, Udaipur and Jyoptipur under Diyun circle, Changlang district of Arunachal Pradesh were heavily devastated by the Nai-Dihing River. This flood rendered hundreds of families homeless. Their house, cattle and other movable properties were washed away and submerged under water. After such disaster and left with no other option they temporarily moved from Dumpani, Jyotipur and Udaipur village to government upper primary school Diyun, under Diyun circle. However, they received a notice from school headmaster and school managing committee to vacate the premises as the academics session for 2016-2017 had resumed and accordingly they vacated the school and were compelled to settle in the vacant land situated between Juotsnapur and Rajnagar village, under Diyun Circle, Changlang district. The range forest officer, diyum forest range, diyum identified the petitioners as encroacher as the said area fall under forest reserves and issued several memoranda as well as eviction notice to the Petitioners. Lastly, they passed an eviction order against the Petitioners and evicted them without making proper alternative arrangement. The court noticed that the Petitioners were evicted from the land under their occupation, as a result of which they are left with no proper food, water or shelter or even medical facilities. The learned government advocate submitted that out of the flood affected people, majority of them have already returned to their designated settlement area. There were 20 male, 24 female, 16 children and four infants, who were residing in the relief camp and the district administration had taken all necessary steps to ensure that proper food, water and medical facilities are made available to them.
