SLIC takes up battle to rehabilitate Arjun Das Slum Cluster residents: Delhi HC grants interim protection from demolition

Jhuggi Jhopri Ekta Manch, an organisation working on housing rights for poor slum dwellers and struggles against forced evictions, approached Human Right Law Network along with the residents of Arjun Das Slum Cluster in an emergency situation on 9th June when they found state authorities at their locality with bulldozers threatening to demolish their houses. With great difficulty, residents managed to convince the authorities to withhold the demolition on that day but residents were threatened that bulldozers would return on 11th June. The Residents had been surveyed by the Municipal Corporation of Delhi in 2008, and the law requires that people be rehabilitated before their slum or JJ Clusters are evicted. But this rehabilitation was not done. On 11th SLIC lawyers filed an interim application seeking proper survey and rehabilitation prior to the demolition. Hon'ble High Court, while hearing the application directed authorities not to carry out any demolition of Jhuggis in question for a period of one week and liberty was granted to Petitioner to come up with a fresh Petition in such period. Accordingly within one week a comprehensive Public Interest Petition was filed and came up for hearing before Vacation Bench for hearing on 18.06.12. Hon'ble Delhi High Court has pleased to admit the case for hearing and has issued notice to the State and has granted protection order against demolition till the Court hears this matter again on the next date in September-2012.
