Monu Ram Vs. U.O.I Monu Ram is a visually impaired individual who applied for the post of clerk in the department of higher education Chandigarh. The said post require a second class graduate with computer knowledge. To short list the candidates they were required to clear a written test in which minimum marks were fixed. Since Monu Ram is visually impaired he moved an application before the authority to appoint a scribe for the test who could write for him and the same was provided by the authorities. According to the instructions issued by the government of India along with the writer, the disabled are entitled to get 20 minutes extra per hour in caparison to the general candidates. Monu Ram in his application only asked for the scribe but did not mention the allowance of extra time. He was not granted extra time as per instructions. He could not complete his written test and lost the same with the margin of 2.5 marks. The Petitioner prays before the Administrative Tribunal either to grants 2.5 marks or to re-conduct the test.The petitioner’s plea was since the department knew that he is disable as he is visually impaired whether he has asked for extra time in his application it becomes irrelevant. He was entitled to get 20 minutes extra per hour in caparison to the general candidates according to the order passed by the Authorities. Status The tribunal agreed with the Petitioner’s submission and the petition has been allowed and the test has been re-conducted .
